
A proposed class action settlement is offering cash payments and monitoring services to millions affected by a data breach at a health care company.
The agreement stems from the Crowe v. Managed Care of North America (MCNA) class action lawsuit filed in the U.S. District Court for the Southern District of Florida and covers all living people who were sent a notice of the potential compromise of their private information, says the official claims administrator.
The breach potentially exposed patients’ personal and protected health information when hackers accessed MCNA’s computer systems between February 26th and March 7th, 2023. Nearly 9 million people may have been impacted by the cybersecurity incident.
Class members can claim up to $2,500 each for documented out-of-pocket losses, subject to a $250,000 total cap, by submitting forms before October 19th.
They will also automatically receive two years of medical data monitoring after enrolling once the court grants final approval.
The firm denies all allegations of negligence and breach of implied contract and no court has found it liable. MCNA has committed to ongoing security improvements.
MCNA is a dental insurer that operates in several states, including Arkansas, Idaho, Iowa, Louisiana, Nebraska, Texas and Utah.
The final approval hearing is set for November 16th.
