California Governor Gavin Newsom signed a law on Sept. 27 that bars state and local public officials from issuing meme coins. The measure, Assembly Bill 2409, was part of a package covering public ethics, crypto crime and consumer protection.

“No official should profit off their office,” Newsom said. He tied the law to concerns about politicians earning money from digital assets.

Assemblymember Avelino Valencia introduced the bill on Feb. 20, 2026. The Assembly passed it 77-0 in May, and the Senate approved the final version 40-0 in August.

Who the California Meme Coin Ban Covers

The law applies to state and local elected or appointed officials, state legislators and members of government boards, commissions and committees. It also covers government employees who have decision-making power over bids and contracts.

The law defines issuing a coin as making it available for public purchase, donation or exchange of value. This applies whether or not the coin is promoted.

A separate rule targets crypto platforms serving California residents. From Jan. 1, 2027, they cannot list a meme coin issued on or after that date if it is offered by, or in partnership with, a federal official or a California state or local officer.

Politician-linked tokens issued before that date fall outside the listing rule. The law does not ban meme coin trading in general.

The law relies on civil enforcement rather than creating a new crime. The attorney general, district attorneys, city attorneys and county counsel can file civil actions seeking injunctions and disgorgement.

In February 2025, staff at the U.S. Securities and Exchange Commission said most meme coins are generally not securities under federal law. The staff also warned that buyers do not receive protections under those laws.

Newsom Points to Trump’s Meme Coin

Newsom used the signing to criticize President Donald Trump’s Official Trump meme coin and other crypto businesses. His office cited reports that nearly one million TRUMP buyers lost more than $3 billion combined.

Trump’s 2025 financial disclosure, released June 30, lists $635,068,835 in royalties from a licensing deal under CIC Digital LLC. Reporting has linked that deal to the TRUMP meme coin business.

Nansen blockchain data from July 2026 showed about 988,905 wallets with combined unrealized losses of $3.81 billion. These figures are estimates based on blockchain analysis.

The White House has disputed claims that Trump’s business interests create conflicts of interest. Representatives have said Trump and his family have not engaged in such conflicts.

Newsom also signed Senate Bill 1208, introduced by Senator Tim Grayson. It extends California’s money laundering law to digital asset transactions until Jan. 1, 2032.

The law lets authorities seek warrants to seize digital assets from exchanges, issuers and custodians. Law enforcement can also send freeze requests, which require recipients to freeze the identified assets for 10 calendar days.

Verified victims can seek compensation through a court process. Assets left undistributed after three years must go to California’s Restitution Fund for victim services.

The meme coin listing restriction under AB 2409 applies to tokens issued on or after Jan. 1, 2027.
