Capital One is pushing back against claims of political bias in a federal lawsuit by seeking dismissal of the case tied to its 2021 closures of Trump Organization accounts.

Attorneys for Capital One filed the motion in the Southern District of Florida and stressed that the process remained confidential while providing the Trump Organization with several months of advance notice plus extensions to transition banking services.

The Trump Organization and Eric Trump filed the suit in March 2025 alleging the closures stemmed from political motivations after the January 6 Capitol events.

Capital One counters that its team drew on decades of law enforcement expertise to assess risks without accusing any party of actual money laundering violations.

Background context includes a January 2021 Financial Crimes Enforcement Network (FinCEN) enforcement action that imposed a $390 million penalty on the bank for earlier anti-money laundering program shortcomings between 2008 and 2014 in its check cashing operations.

The filing argues that discovery has not uncovered evidence making the compliance rationale a pretext and seeks full dismissal of the amended complaint.

Similar debanking disputes have involved other major banks in recent years amid broader accusations of targeting conservative clients.
